This website, together with all emails, electronic communications, documents, marketing material and information issued by Explore Realty, is provided for general information and property-related purposes.
While every reasonable effort is made to ensure that information supplied by Explore Realty is accurate and current, no representation or warranty, express or implied, is given as to its accuracy, completeness, availability or suitability for any particular purpose.
Users and recipients should independently verify any information that is material to a property transaction before relying on it.
2. Banking Details & Payment Fraud
IMPORTANT FRAUD WARNING
Explore Realty takes the security of its clients and business partners seriously.
Our banking details will not change without formal written communication from Explore Realty. However, email communications may be intercepted, altered or fraudulently imitated.
Before making any payment, the payer is responsible for independently verifying the banking details directly with Explore Realty using a known and trusted telephone number or other independently verified contact method.
Do not rely solely on banking details contained in an email, attachment, WhatsApp message or other electronic communication.
Explore Realty operates on an invoice-based payment system. Payments should only be made against a valid invoice issued by Explore Realty and after the banking details have been independently verified.
Explore Realty will never request a change of banking details merely by sending replacement banking details in an email or electronic message without appropriate formal communication and verification.
To the fullest extent permitted by law, Explore Realty cannot accept responsibility for funds paid into an incorrect, fraudulent or unauthorised bank account where the payer failed to independently verify the banking details before payment.
If you receive any communication purporting to change Explore Realty's banking details, do not make payment until you have spoken directly to an authorised representative of Explore Realty and verified the instruction.
3. Property Information
Property descriptions, photographs, floor areas, erf sizes, rates, taxes, levies, rental amounts, purchase prices, zoning information, availability, maps, measurements, amenities and other property-related information are provided in good faith based on information available to Explore Realty at the time.
Some information may be supplied by property owners, landlords, tenants, developers, managing agents, municipalities, body corporates, homeowners' associations, third-party service providers or property information platforms.
Although reasonable efforts are made to verify information, Explore Realty does not warrant that all information is complete or free from error.
Prospective purchasers, sellers, landlords and tenants are encouraged to independently verify information that is important to their decision before entering into any transaction.

4. Property Transactions & Agreements
No information contained on this website, in an advertisement, email or other communication should be interpreted as creating a binding agreement unless contained in a properly completed and signed written agreement between the relevant parties.
Any sale, lease, mandate or other property transaction remains subject to the terms and conditions contained in the applicable signed agreement.
Where there is any inconsistency between marketing material, electronic communications and a signed agreement, the signed agreement will take precedence, subject to applicable law.

Information supplied by Explore Realty is provided in the ordinary course of providing property practitioner services.

6. POPIA & Protection of Personal Information
Explore Realty respects the privacy of clients, prospective clients, property owners, tenants, purchasers, service providers and other persons with whom we interact.
Personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and other applicable South African legislation.
Personal information may be collected and processed where reasonably required to:
- provide property-related services;
- market, sell, purchase, let or manage property;
- communicate with clients and prospective clients;
- process enquiries and applications;
- prepare or facilitate property transactions;
- comply with legal and regulatory obligations;
- perform client identification and verification;
- prevent fraud and financial crime;
- maintain business and transaction records; and
- protect the legitimate interests of Explore Realty, its clients and other parties.
Reasonable technical and organisational safeguards are implemented to protect personal information against loss, unauthorised access, unlawful processing, alteration or disclosure.
Where information must lawfully be provided to attorneys, bond originators, financial institutions, compliance providers, property platforms, regulators or other parties involved in a transaction, it may be shared to the extent reasonably necessary and permitted by law.

7. FICA Compliance
Explore Realty complies with its applicable obligations under the Financial Intelligence Centre Act 38 of 2001, as amended ("FICA").
As part of these obligations, Explore Realty may be required to obtain and verify information relating to clients, representatives, beneficial owners, entities and transactions.
Clients may therefore be requested to provide identification, proof of address, company or trust documentation, beneficial ownership information, source-of-funds information and other documents reasonably required for regulatory compliance.
Explore Realty reserves the right to delay or decline to proceed with a transaction or business relationship where legally required information cannot be obtained or verified or where proceeding would be contrary to applicable legislation.
Applicable regulatory reporting obligations will be complied with where required by law.
8. Property Practitioners Regulatory Authority
Explore Realty is registered with and regulated by the Property Practitioners Regulatory Authority ("PPRA") in accordance with the Property Practitioners Act 22 of 2019 and applicable regulations.

Individual property practitioners operating under Explore Realty are required to comply with applicable PPRA registration and regulatory requirements.
9. Confidentiality of Electronic Communications
Emails and other communications sent by Explore Realty, including any attachments, may contain confidential, privileged, proprietary or personal information.
Such communications are intended solely for the person or persons to whom they are addressed.
If you receive a communication in error, please notify the sender and delete the communication and any attachments. You should not copy, distribute, disclose or rely upon the contents.
Transmission of information electronically cannot be guaranteed to be completely secure, uninterrupted, error-free or free from malicious software.
Recipients are responsible for maintaining appropriate cybersecurity and anti-virus protections on their own systems.
10. Authority of Employees and Property Practitioners
No employee, property practitioner, representative or contractor of Explore Realty has authority to bind Explore Realty to an agreement, representation, guarantee or undertaking unless such authority exists and the relevant undertaking is made in accordance with Explore Realty's authorised procedures.
Statements made in informal conversations, WhatsApp messages, emails or other communications should not be regarded as amendments to signed contractual terms unless formally agreed in writing by authorised parties.

- interruption or unavailability of electronic services;
- malicious software or cybersecurity incidents outside Explore Realty's reasonable control;
